General Terms and Conditions of Sale

These General Terms and Conditions of Sale (“Terms”) apply to all sales of products and services (“Products”) by MyTCGPlaymat (“we,” “us,” “our”) to you, the customer (“you,” “your”). By placing an order with us, you agree to be bound by these Terms.
 

1. Definitions
 

1.1 Agreement: These Terms and any other terms agreed upon in writing by the parties.

1.2 Products: All goods and services offered for sale by MyTCGPlaymat.

1.3 Order: A request by you to purchase Products from us.

1.4 Parties: MyTCGPlaymat and the customer.

 

2. Orders
 

2.1 Order Placement: Orders can be placed through our website, by email, or by phone. All Orders are subject to acceptance by us.

2.2 Order Confirmation: Once an Order is placed, we will send you an order confirmation. The Order is considered accepted once the confirmation is sent.

2.3 Order Changes: Any changes to an Order must be requested in writing and are subject to our approval.
 

3. Prices and Payment
 

3.1 Prices: Prices for Products are as listed on our website or as quoted. Prices are subject to change without notice.

3.2 Taxes: Prices exclude all applicable taxes, duties, and charges unless otherwise stated.

3.3 Payment Terms: Payment is due at the time of order unless otherwise agreed in writing. We accept payment by Stripe.

 

4. Delivery
 

4.1 Delivery Terms: Delivery dates are estimates and not guaranteed. We will use reasonable efforts to deliver Products within the estimated delivery time.

4.2 Shipping Costs: You are responsible for all shipping and handling costs unless otherwise stated.

4.3 Risk of Loss: Risk of loss or damage passes to you upon delivery of the Products to the carrier.

4.4 Delivery Issues: If you do not receive the Products within a reasonable time, please contact us. We will work to resolve the issue.
 

5. Title and Ownership
 

5.1 Title Transfer: Title to the Products passes to you upon full payment of the purchase price.

5.2 Retention of Title: We retain title to the Products until full payment is received.
 

6. Inspection and Acceptance
 

6.1 Inspection: You must inspect the Products upon receipt and notify us of any defects or discrepancies within [number of days] days.

6.2 Acceptance: Products are deemed accepted if no notice of defect or discrepancy is received within the specified period.
 

7. Returns and Refunds
 

7.1 Return Policy: Products may be returned within 14 days of delivery for a refund or exchange, subject to our return policy.

7.2 Return Conditions: Returned Products must be in their original condition and packaging.
You are responsible for return shipping costs.

7.3 Refunds: Refunds will be processed within 3 days of receiving the returned Products.
 

8. Warranty
 

8.1 Warranty Period: We warrant that the Products will be free from defects in materials and workmanship for 2 days from the date of delivery.

8.2 Warranty Claims: To make a warranty claim, you must notify us in writing within the warranty period and provide proof of purchase.

8.3 Remedies: Our sole obligation under this warranty is to repair or replace the defective Products, or at our option, to refund the purchase price.
 

9. Limitation of Liability
 

9.1 Exclusion of Damages: We are not liable for any indirect, incidental, special, or consequential damages arising out of or related to the sale of Products.

9.2 Limitation of Liability: Our total liability for any claim arising out of or related to the sale of Products is limited to the purchase price of the Products.
 

10. Force Majeure
 

10.1 Definition: We are not liable for any delay or failure to perform due to causes beyond our reasonable control, including acts of God, natural disasters, terrorism, labor disputes, and governmental actions.

10.2 Notification: If a force majeure event occurs, we will notify you as soon as possible and make reasonable efforts to mitigate the effects of the event.
 

11. Miscellaneous
 

12.1 Entire Agreement: These Terms constitute the entire agreement between the parties and supersede all prior agreements or understandings.

12.2 Amendments: Any amendments to these Terms must be in writing and signed by both parties.

12.3 Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

12.4 Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
